I live in the state of Illinois. My child’s father and I havent been together since right after his 1st birthday and he will be 3 in June.
I have some question’s about the laws and regulations about child support and custody in the state of IL.
I havent taken him to court for any of these things for numerous different reasons but lately i have been pondering it. I want to go to school for alternative medicine but IL doesnt offer any schooling for what I want to do, this means I’ll eventually have to pursue that career by getting an education out of state and relocating. That is one reason why i have been hesitant to take him to court, I know he will request that I stay in the state of IL but I feel like i have no opportunity to prosper and prepare a stable and financially secure home life for my family in IL.
I got married in February to a wonderful man who is great to my son and cares for him as if he were his own. He was diagnosed with manic depression (the most intense of the two bipolar disorders) and had some complications with that for which he know draws SSI. I read somewhere that during a custody and child support case, they look into the mental health history of new step parents and determine whether or not the child is better off in or out of that step- parents care. He is stable now and has been for 2 years and I would be devastated if the judge made a bad decision based on his past.
I dont make a lot of money and my son is almost 3 and i havent been able to afford to put him in daycare which I think is important for his development. They have cut preK state funded programs so he is too young to go to school until he’s 5 which is outrageous in my opinion. His father helps in absolutely no way financially for ANYTHING. One reason i want him to pay child support is so i can put my son through daycare without hassling him or the state for help.
I’m afraid to take him to court for child support bc i dont even want him to get joint custody. That doesnt mean i dont want him to see him, he can and does see him whenever he wants (meaning whenever its convenient for him) and custody rights wont take his time away but i dont want him to have the right to pull him outta school without my consent and things like that. I want full custody with him to have the right of visitation.
He is an incredibly irresponsible person, he works 1 day a week, his parents pay his bills and provide my sons necessities and i dont trust that he cares for him properly when hes there.
Someone please just give me some advice, ease my anxieties about this process me, and inform me of what the laws and regulations are for this situation. I appreciate it!
@ sheniquah- Bc I cant rely on his dad to care for him everytime I work. Because i work FULL TIME and so does my husband. BC daycare is good for a childs development. Bc he needs to be around other children his age… Is it just me or is yours a really stupid answer? GTFO
@ John- I have asked him to help me pay, he said he couldnt but that he could enroll him in the “chasi program” (a state funded benefit for people with low income) but only the stipulation that my son will have to move in with him. HAHAH yeah freakin right, over my dead body will my son live with a man who cant even support himself.
p.s. the Chasi program is a state funded program provided only by the county his father lives in. I live 25 minutes outside that county, i do not qualify for any state funded programs.
